  1. Frequency of opportunity: The program must allow individuals eligible for tobacco cessation to qualify for the lower premium at least once annually.
  2. Size of reward: The premium difference cannot exceed 50% of the total cost of employee-only coverage under the plan, or if applicable, 50% of the total coverage cost for employees and dependents.
  3. Reasonable design: Tobacco cessation programs must be designed to promote health or prevent disease, offering reasonable assistance to tobacco users to improve their health.
  4. Uniform availability and alternative standards: Lower premiums must be available to all similarly situated individuals, with reasonable alternative standards provided for those for whom meeting initial requirements is unreasonably difficult due to medical reasons.
  5. Notice of alternative means: Plans must disclose in all materials the terms of tobacco cessation programs and the availability of a reasonable alternative standard.
